An Offer in Compromise (OIC) allows eligible taxpayers to settle their IRS debt for less than the full amount owed. One form of relief—Doubt as to Liability—applies when there is a genuine dispute as to whether the tax assessed is correct. This type of offer does not focus on your ability to pay, but rather on whether the IRS has properly determined that you owe the tax in the first place. We help you build a compelling case by identifying errors in the IRS’s assessment, providing legal and factual support, and submitting all required documentation and forms to challenge the validity of the liability. This approach can be especially useful when the IRS has assessed tax due to missing records, substitute returns, or misapplied law.
In contrast, the more common types of Offers in Compromise—Doubt as to Collectability and Effective Tax Administration—require taxpayers to qualify under the IRS’s strict financial guidelines. Doubt as to collectability is based on the taxpayer’s inability to pay the full tax debt before the statute of limitations expires. Effective Tax Administration applies when paying the tax would cause significant economic hardship, even though the liability is correct and the taxpayer technically has the means to pay. These financial-based offers require detailed disclosures of income, expenses, assets, and liabilities, and are closely scrutinized by the IRS.
